On your "Mariabackup Overview" page, you mention that this tool is based on version 2.3.8 of XtraBackup - https://mariadb.com/kb/en/library/mariabackup-overview/

There have been numerous bug fixes and improvements made by XtraBackup since that version (as they are on 2.4.13).

Would there be any risk that MariaBackup doesn't contain some of these and could cause unexpected behavior?

Could all those Percona changes be merged to MariaBackup?

There have been numerous bug fies and improvements made by Mariabackup since that version. Perhaps more numerous than in Xtrabackup.
In fact, we based the original version on 2.3.8 and went separate ways since. If there is a specific bug fix in percona , which affects you and is fixed by percona, we will evaluate and have a look.
But we won't rebase MariaBackup on 2.4.13, especially since 10.2 the codebase differs very significantly, and rebasing is not time well spent.
